These Terms of Service (“Terms”) govern the use of the site https://dreamapp.cloud (the “Site”) and of all the contents, features and services made available within it (the “Services”), offered by PUB NEW DREAM S.R.L..

2. Acceptance of the Terms
Accessing and using the Site implies full acceptance of these Terms. If the user does not agree, they must refrain from using the Site and the Services. The Controller reserves the right to amend these Terms at any time; continued use after changes constitutes acceptance of the new conditions.
3. Purpose of the Site and Services
The Site has an informational and commercial purpose and is dedicated to presenting the New Dream App software solution, a POS platform for restaurants and the Ho.Re.Ca. sector. Services include, without limitation:
- browsing informational content about the products;
- submitting contact requests via the dedicated form;
- optionally subscribing to the newsletter.
4. Eligibility
The use of the Site is reserved to adults with the legal capacity to enter into binding obligations under the applicable law.
5. Acceptable use
The user agrees not to:
- use the Site in violation of laws, regulations or third-party rights;
- attempt to access restricted areas or compromise the security, stability or integrity of the Site (including by mass scraping, automated scanning or unauthorised fingerprinting);
- transmit viruses, malware, malicious code or unlawful, defamatory, offensive or pornographic content;
- impersonate third parties or falsify the origin of their communications;
- use the contents of the Site for competing commercial purposes without the Controller's written authorisation.
6. Intellectual property
All trade marks, logos, denominations (“the New Dream App” and related marks), text content, graphics, photographs, videos, source code and software on the Site are the exclusive property of the Controller or of its licensors and are protected by national and international intellectual property laws. Any unauthorised reproduction, distribution, modification or use is prohibited.
7. User-submitted content
By submitting a contact request or subscribing to the newsletter, the user warrants the truthfulness and accuracy of the information provided and represents that they have the right to communicate it. Processing of personal data is governed by the Privacy Policy.
8. Disclaimer and limitation of liability
The Site contents are provided for information purposes only and do not constitute professional advice, legal, tax or contractual consultancy, nor a binding offer to the public under art. 1336 of the Italian Civil Code. The Controller endeavours to ensure the accuracy of the contents but does not guarantee their correctness, completeness or constant updating.
Within the limits of the applicable law, the Controller shall not be liable for indirect, consequential damages, lost profits or data loss arising from the use of the Site. The mandatory rights of consumers under Italian Legislative Decree 206/2005 (Consumer Code) and other applicable laws remain unaffected.
9. Third-party links
The Site may contain links to external resources. Such links are provided for the user's convenience; the Controller does not control nor is responsible for the contents of third-party sites and recommends always reading their respective policies.
10. Cookies and personal data
How personal data and cookies are handled is described in the Privacy Policy and in the Cookie Policy.
11. Site availability
The Controller endeavours to keep the Site available continuously but does not guarantee the absence of interruptions or malfunctions due to maintenance, updates, cyber attacks or force majeure events.
12. Changes to the Site and Services
The Controller reserves the right to modify, suspend or discontinue, in whole or in part, the Site and the Services at any time without notice and without any obligation towards the user.
13. Governing law and jurisdiction
These Terms are governed by Italian law. Any dispute arising from the use of the Site shall be exclusively referred to the Court of Fermo, Italy, without prejudice to mandatory consumer protection rules.
14. ODR — Online dispute resolution
In compliance with art. 14 of Regulation (EU) 524/2013, the consumer user is informed of the possibility to use the online dispute resolution (ODR) platform of the European Commission, available at ec.europa.eu/consumers/odr.
